When you use ADATA products or services, you do not necessarily have to provide personal data as required by Us. However, if you choose not to provide said personal data, we might not be able to provide products or services to you or answer your questions in many cases.
1.1 Personal data collected by ADATAPersonal data refer to the data that can directly or indirectly identify you personally, such as your name, phone number, email address, gender, territory, date of birth, or IP address. ADATA will collect your personal data only after obtaining your consent:

When you log into the ADATA Membership Center. you can choose to provide additional data in the “personal data” section (e.g., gender and date of birth). You can also choose to provide personal data (such as any other information that may identify the products, including product categories, serial numbers, purchase dates, and purchase channels) related to ADATA membership services when using the services (e.g. product registration and product data record queries).
Customer serviceWhen you purchase ADATA products from Us (such as ADATA's official shopping platform) or use the paid service, you might need to provide your name, mailing address (including postal code), phone number, email address, and payment information.
Meanwhile, when you ask Us for customer support services (such as product repair), we might need to ask you to provide additional identification information for your product (such as product serial number or product model No.) in addition to said information.
Marketing activitiesWhen you participate in marketing activities or contests with prizes organized by ADATA, you might need to provide your name, phone number, email address, date of birth, gender, product identification information (such as product serial number and product model No.), and other personal data, subject to the types of activities you participate in. If you are a contest winner of a prize or to receive gifts, you may need to provide your mailing address (including postal code), information necessary for tax declaration (such as a photocopy of your household registration address or ID card/passport number), etc. Further, if We are to provide you with product rebates through said marketing activities, we might need to ask you to provide additional remittance information in addition to the personal data you provided when participating in said marketing activities or prize contests.

User experience survey and analysis for developing and evaluating ADATA’s new products, services, and functions. Further improve and upgrade ADATA products and services.
Complete ADATA member account creation and experience ADATA member related services (such as "Product Registration").
Provide services (including proof of purchase or invoice), product software upgrades, or product and service update notifications for the ADATA products or services you purchased from ADATA.
Complete your subscription to marketing materials related to this service such as ADATA related news, discounts, marketing activities, and other information. Please note that you have agreed to ADATA's use of your personal data when you complete the subscription, and you may cancel the subscription at any time.
We hereby send you the important notices related to your rights, e.g., when the terms and policies applicable to ADATA products or services are changed. Please note that you cannot cancel the delivery of these notices to safeguard your rights and interests.
When you participate in Our marketing activities or contests with prizes; your personal data will be used to confirm your qualifications, advise you of any event updates, communicate with you for awards delivery contact matters, provide product rebates, declare tax, and purchase insurance for you if any shuttle service is required for the event.
When you contact ADATA or visit ADATA’s maintenance base or office building; your personal data and audio/video/conversation record data collected by Us will be used to provide your support services (such as maintenance services, reply to your questions or inquiries) or customer care, satisfaction surveys, retrieve feedback, maintain your rights, and ensure the safety of personnel in the area.
Personalized marketing, such as third-party advertising cookies, provides you with marketing and advertising content that meets your personal preferences as well as recommend service content that suits you based on how you have used ADATA products or services in the past.

The de-identified data or device identification information refers to the data that cannot directly or indirectly identify you, such as your product model No., software version or invoice date. When you use ADATA products or services, we might collect the following de-identified data or device identification information via ADATA products and services for various possible purposes. Meanwhile, when the following de-identified data or device identification information is linked to your personal data, we will also treat the de-identified data or device identification information as your personal data and provide appropriate protection:
When you use ADATA products or services, we might collect the data generated by the App on your products or services as well as your behavior and interaction with the App, e.g. the name and version of the App and software, the time when you installed and uninstalled, the number and time of your log in and out, the number and frequency of use, the frequency and time of your opening and closing the App, the type of the App and software you prefer, usage habit settings, or App and software update versions and results.
When you ask Us for customer support services (such as product maintenance) or participate in Our marketing activities, we may have to ask you to provide the product purchase information (such as invoice purchase date or purchase store).
As described in Sections 1.2 and 1.3 and in accordance with legal requirements, after collecting your personal data, ADATA can only use the data for the following purposes: 040 Marketing (including financial holding group joint marketing), 090 Consumer and customer management and services, and 157 Surveys, statistics, and research analysis.
2. Personal data retention periodWe will retain your personal data for the period necessary to complete the purpose of use described in the Policy, or will not retain the data for a longer period unless in the event of the following legal or necessary circumstances: i.e., we will retain your personal data for an appropriate and reasonable period of time for customer relationship management or to comply with tax laws or other legal requirements, or retain your personal data for a specific period as required by law or to cooperate with government or judicial authorities' investigation or litigation. Moreover, if you have initially provided consent for ADATA to collect your personal data but later wish to withdraw this consent, we will no longer continue to collect your personal data after you withdraw your consent, but will only keep what We have collected from you before you withdraw your consent.
3. Whom We disclose your personal data toADATA will not disclose the personal data collected from you to other third parties except under any of the following circumstances:
3.1 We have obtained your consentWe will only disclose and share your personal data with third parties other than ADATA after obtaining your consent or when you requested Us to share the data.

Cross-border TransmissionYou acknowledge and agree that when you use ADATA products or services, participate in ADATA activities or provide your personal data to Us, your personal data might undergo cross-border transmission, storage, processing, and utilization between Our affiliated companies and service providers in various countries (including within and outside the EU). Security measures for ADATA products and servicesWe adopt appropriate technical and organizational information security protection measures such as the internal inspection conducted against personal data collection, storage and processing and physical security measures, in order to prevent any theft, tampering, disclosure or damage and prevent intrusion into the system where We store your personal data. Our affiliated companies in various countries and we also use secure network dedicated lines for data transmission. When you provide personal data to Us, your personal data will be protected both online and offline. However, we cannot guarantee that the overall network environment is safe and secure. 8.1 Properly protect your ADATA member account, for example:For security, you should use your own account and password to login as an ADATA member. You shall be responsible for maintaining the confidentiality of your ADATA member's account password, user name, and any acts performed using your ADATA member account.
Change your ADATA member password regularly to prevent any unauthorized access, use, or deletion without your permission.
When your ADATA member account password is stolen, please contact Us immediately, promptly suspend or terminate your ADATA member account password permission (or partially), and remove any information related to your ADATA member.
8.2 Update your anti-virus softwareYou should also update your anti-virus software and use anti-virus or malware scanning programs to ensure the security of your personal data.
9 How do We Manage your InformationWhat you can do if you have any questions or requests regarding your personal data is that you can log into the ADATA Membership Center or refer to relevant functions and descriptions of ADATA products or services that you use, or contact us via e-mail at pdata@adata.com
9.1 ADATA Member Account:Please provide your correct member information, so that ADATA can provide the corresponding products or services to you.
You can also enter the "ADATA Member Center" to update, modify, and view your ADATA member information at any time.
If you want to subscribe for or cancel the subscription for the newsletter, you can go to the "ADATA Member Center" to change the setting at any time. If you choose to cancel the subscription for the newsletter, please note that it will take about 2 working days to complete the process.

9.4 [Please note] the following exceptionsWe are always committed to ensuring the correctness of your personal data and protect your personal data from any accidental or malicious destruction. However, we cannot guarantee that We can meet this requirement when any of the following situations occur:

Privacy Right for MinorsWe will not collect personal data from minors under the age of eighteen (18) or otherwise specified in accordance with local laws or regulations without the knowledge of, or obtaining consent from, the minors’ legal representatives. We suggest that the legal representatives should accompany the minors throughout the process of using ADATA products or services. If you are a minor, please obtain consent from your legal representative. You may only provide personal data to Us after you have obtained consent from your legal representative.
Your legal representative may withdraw any consent at any time and contact us by e-mail at pdata@adata.com to update, access, delete, view, download, or reject our use of part or all of your personal data you provided or restrict the purposes for which we use your personal data.

Special or Sensitive Personal DataWe will not ask you to, and please do not, provide special or sensitive personal data to ADATA, such as your medical history, medical or health examination records, political orientation, religious and philosophical beliefs, race, union member information, sexual orientation, sexuality Life, criminal record or genetic data.

If you continue to use ADATA’s products or services after the Policy is revised, you are deemed to have agreed to Our revised policy.
