Privacy Policy

ADATA Technology Co., Ltd. (including its subsidiaries and affiliates, hereafter collectively referred to as “ADATA,” “Us,” “Our,” or “We”) respects and pledges to protect your personal privacy. We are committed to protecting your personal data security according to the relevant laws and regulations. The privacy policy (hereinafter referred to as the "Policy") will help you understand how We collect, use, store and protect the personal data We obtain from you through ADATA products and services. Meanwhile, we will also explain how, and to whom, We disclose and transfer your personal data.

If you are a minor, you shall have your legal representative read and understand the Policy before you can use this service. If you use this service and you or your legal representative agree to provide your personal data to us, it will be deemed that you or your legal representative have/has agreed to the Policy.

1. The data We collect and the method of collection:

When you use ADATA products or services (such as, ADATA's official website, customer support services, etc.), we might collect the personal data that you provide to Us via your access to ADATA products and services. We will collect your personal data based on the specific data collection purposes for the ADATA products and services that you actually use. Meanwhile, when you use ADATA products and services, we might also collect the following de-identified data and device identification information that cannot identify you personally (please refer to the following Section 1.3 for explanation).

When you use ADATA products or services, you do not necessarily have to provide personal data as required by Us. However, if you choose not to provide said personal data, we might not be able to provide products or services to you or answer your questions in many cases.

1.1 Personal data collected by ADATA

Personal data refer to the data that can directly or indirectly identify you personally, such as your name, phone number, email address, gender, territory, date of birth, or IP address. ADATA will collect your personal data only after obtaining your consent:

When you register for ADATA membership, you will need to provide accurate registration details, including your name, email address, country/region, phone number, and location.

When you log into the ADATA Membership Center. you can choose to provide additional data in the “personal data” section (e.g., gender and date of birth). You can also choose to provide personal data (such as any other information that may identify the products, including product categories, serial numbers, purchase dates, and purchase channels) related to ADATA membership services when using the services (e.g. product registration and product data record queries).

Customer service

When you purchase ADATA products from Us (such as ADATA's official shopping platform) or use the paid service, you might need to provide your name, mailing address (including postal code), phone number, email address, and payment information.

Meanwhile, when you ask Us for customer support services (such as product repair), we might need to ask you to provide additional identification information for your product (such as product serial number or product model No.) in addition to said information.

Marketing activities

When you participate in marketing activities or contests with prizes organized by ADATA, you might need to provide your name, phone number, email address, date of birth, gender, product identification information (such as product serial number and product model No.), and other personal data, subject to the types of activities you participate in. If you are a contest winner of a prize or to receive gifts, you may need to provide your mailing address (including postal code), information necessary for tax declaration (such as a photocopy of your household registration address or ID card/passport number), etc. Further, if We are to provide you with product rebates through said marketing activities, we might need to ask you to provide additional remittance information in addition to the personal data you provided when participating in said marketing activities or prize contests.

As described above, the categories of personal data collected by ADATA include C001 Personal Identifiers, C002 Financial Identifiers, C003 Government Identifiers, C011 Personal Descriptions, C093 Financial Transactions, and C132 Unclassified Data.

1.2 Personal data collected by ADATA

The personal data We collect will be used for the following purposes:

User experience survey and analysis for developing and evaluating ADATA’s new products, services, and functions. Further improve and upgrade ADATA products and services.
Complete ADATA member account creation and experience ADATA member related services (such as "Product Registration").
Provide services (including proof of purchase or invoice), product software upgrades, or product and service update notifications for the ADATA products or services you purchased from ADATA.
Complete your subscription to marketing materials related to this service such as ADATA related news, discounts, marketing activities, and other information. Please note that you have agreed to ADATA's use of your personal data when you complete the subscription, and you may cancel the subscription at any time.
We hereby send you the important notices related to your rights, e.g., when the terms and policies applicable to ADATA products or services are changed. Please note that you cannot cancel the delivery of these notices to safeguard your rights and interests.
When you participate in Our marketing activities or contests with prizes; your personal data will be used to confirm your qualifications, advise you of any event updates, communicate with you for awards delivery contact matters, provide product rebates, declare tax, and purchase insurance for you if any shuttle service is required for the event.
When you contact ADATA or visit ADATA’s maintenance base or office building; your personal data and audio/video/conversation record data collected by Us will be used to provide your support services (such as maintenance services, reply to your questions or inquiries) or customer care, satisfaction surveys, retrieve feedback, maintain your rights, and ensure the safety of personnel in the area.
Personalized marketing, such as third-party advertising cookies, provides you with marketing and advertising content that meets your personal preferences as well as recommend service content that suits you based on how you have used ADATA products or services in the past.
Any other purposes after obtaining your consent.

1.3 De-identified data and device identification information collected by ADATA, and purposes of the use thereof

The de-identified data or device identification information refers to the data that cannot directly or indirectly identify you, such as your product model No., software version or invoice date. When you use ADATA products or services, we might collect the following de-identified data or device identification information via ADATA products and services for various possible purposes. Meanwhile, when the following de-identified data or device identification information is linked to your personal data, we will also treat the de-identified data or device identification information as your personal data and provide appropriate protection:

When you use ADATA products or services, we might collect the data generated by the App on your products or services as well as your behavior and interaction with the App, e.g. the name and version of the App and software, the time when you installed and uninstalled, the number and time of your log in and out, the number and frequency of use, the frequency and time of your opening and closing the App, the type of the App and software you prefer, usage habit settings, or App and software update versions and results.

When you ask Us for customer support services (such as product maintenance) or participate in Our marketing activities, we may have to ask you to provide the product purchase information (such as invoice purchase date or purchase store).

As described in Sections 1.2 and 1.3 and in accordance with legal requirements, after collecting your personal data, ADATA can only use the data for the following purposes: 040 Marketing (including financial holding group joint marketing), 090 Consumer and customer management and services, and 157 Surveys, statistics, and research analysis.

2. Personal data retention period

We will retain your personal data for the period necessary to complete the purpose of use described in the Policy, or will not retain the data for a longer period unless in the event of the following legal or necessary circumstances: i.e., we will retain your personal data for an appropriate and reasonable period of time for customer relationship management or to comply with tax laws or other legal requirements, or retain your personal data for a specific period as required by law or to cooperate with government or judicial authorities' investigation or litigation. Moreover, if you have initially provided consent for ADATA to collect your personal data but later wish to withdraw this consent, we will no longer continue to collect your personal data after you withdraw your consent, but will only keep what We have collected from you before you withdraw your consent.

3. Whom We disclose your personal data to

ADATA will not disclose the personal data collected from you to other third parties except under any of the following circumstances:

3.1 We have obtained your consent

We will only disclose and share your personal data with third parties other than ADATA after obtaining your consent or when you requested Us to share the data.

3.2 Cooperation partner

We compile and de-identify your personal data and convert it into irreversible statistical data that do not allow identification of your identity before disclosing them to our partners, including providers of marketing and promotional content based on your personal preferences (e.g., third-party providers of commercial cookies).

3.3 Service Providers

We may also disclose and share necessary personal data with our service providers to the extent required for them to provide services to you, consistent with the purposes outlined in the Policy. This includes marketing firms that assist in the delivery of marketing materials and the organization of marketing activities, freight companies that transport your purchased or maintained products, financial service providers that handle payments, and customer support service providers (e.g., ADATA customer service hotlines, ADATA online customer service, and ADATA product maintenance services). These service providers utilize your personal data according to our directions and within the purpose and scope defined in the Policy. We also ensure that these providers strictly abide by the Policy.

3.4 For Legal or Protection Purposes

We will disclose and share the necessary items of your personal data to third parties under any of the following conditions for compliance with legal requirements or security purposes:

When it is necessary to comply with laws and regulations; the requirements of the competent authority or judicial unit; comply with legal security requests; or to defend, prevent, or investigate fraud or other illegal acts.

3.1 We Have Obtained Your Consent

We shall only disclose and share your personal information to third parties other than ADATA after obtaining your consent or when you requested Us to share.

Protect the rights, property, and security of ADATA, our service providers, the users, or the public within the scope permitted by law.

4. Period, area, subject and method for use of the personal data:

Unless otherwise required by laws or data retention regulations, ADATA will use the personal data which you directly or indirectly agree ADATA to use, from the date you begin using the Services until the date you terminate them, through automated means or other methods. ADATA uses and transfers said personal data within the territory where it is located and provides services, or shares it with institutions with which ADATA has contractual or business relationships, in order to provide you with better service quality.

5. Cross-border Transmission

You acknowledge and agree that when you use ADATA products or services, participate in ADATA activities or provide your personal data to Us, your personal data might undergo cross-border transmission, storage, processing, and utilization between Our affiliated companies and service providers in various countries (including within and outside the EU). Suchaud cross-border transmission, storage, processing, and utilization behaviors are protected under appropriate measures and shall comply with the Policy and the relevant laws and regulations on personal privacy and personal data security in various countries.

6. Cookies and Similar Technologies

Each time you visit the ADATA website, we will automatically collect certain unidentifiable information. We may use cookies, tags, server logs, and other technologies to obtain or store this information. We collect the de-identified data and device identification information, in order to better understand how people use the ADATA website and improve the overall quality of user experiences in accessing the website.

6.1 Definition of the term “Cookies”

Cookies are short texts used to store information on a web browser. Cookies are widely used to store and receive identification codes and other data on computers, mobile phones, and other devices. We also use other technologies (including data that We store on your web browser or device, and identification codes associated with your device) and other software (including web indicators and pixel tags) for similar purposes. 7. Third-party links and services

ADATA products or services might provide links to other websites, or use third-party services (hereafter referred to as "third parties"). Please acknowledge that such third parties' collection of the personal data has nothing to do with Us. You should read and understand the privacy policy applicable to the third party carefully. Please note that the Policy only applies to products and services provided by ADATA.

8. Security measures for ADATA products and services

We adopt appropriate technical and organizational information security protection measures such as the internal inspection conducted against personal data collection, storage and processing and physical security measures, in order to prevent any theft, tampering, disclosure or damage and prevent intrusion into the system where We store your personal data. Our affiliated companies in various countries and we also use secure network dedicated lines for data transmission. When you provide personal data to Us, your personal data will be protected both online and offline. However, we cannot guarantee that the overall network environment is safe and secure. To protect your rights, we recommend that you should:

8.1 Properly protect your ADATA member account, for example:

For security, you should use your own account and password to login as an ADATA member. You shall be responsible for maintaining the confidentiality of your ADATA member's account password, user name, and any acts performed using your ADATA member account.

Change your ADATA member password regularly to prevent any unauthorized access, use, or deletion without your permission.

When your ADATA member account password is stolen, please contact Us immediately, promptly suspend or terminate your ADATA member account password permission (or partially), and remove any information related to your ADATA member.

8.2 Update your anti-virus software

You should also update your anti-virus software and use anti-virus or malware scanning programs to ensure the security of your personal data.

9 How do We Manage your Information

What you can do if you have any questions or requests regarding your personal data is that you can log into the ADATA Membership Center or refer to relevant functions and descriptions of ADATA products or services that you use, or contact us via e-mail at pdata@adata.com

9.1 ADATA Member Account:

Please provide your correct member information, so that ADATA can provide the corresponding products or services to you.

You can also enter the "ADATA Member Center" to update, modify, and view your ADATA member information at any time.

If you want to subscribe for or cancel the subscription for the newsletter, you can go to the "ADATA Member Center" to change the setting at any time. If you choose to cancel the subscription for the newsletter, please note that it will take about 2 working days to complete the process.

9.2 Settings cookies (please refer to "How to Manage Cookies Settings” in Section 6.4 herein):

You may restrict the use of all or part of the Cookies (i.e., third party cookies) settings, delete the cookies records within your browser, or adjust other settings.

If you do not want Us to provide individualized marketing and ad contents based on your preferences via third party advertising cookies, you can use your browser to reject or delete such third party cookies records.

9.3 Contact ADATA to Manage the Personal Data you Provided:

If you wish to update, access, delete, review, download, and prohibit Our use of some or all of your personal data or membership data you provided to ADATA, restrict Our use of your personal data, you can contact us via the e-mail at pdata@adata.com. Moreover, if you have initially provided consent for ADATA to collect your personal data but later wish to withdraw this consent, you can select this setting for your ADATA products or services at any time (please refer to descriptions provided in Section 9.2). We shall no longer continue to collect your personal data after you withdraw your consent, but will retain what We have collected from you before you withdraw your consent.

9.4 [Please note] the following exceptions

We are always committed to ensuring the correctness of your personal data and protect your personal data from any accidental or malicious destruction. However, we cannot guarantee that We can meet this requirement when any of the following situations occur:

Circumstances whereby We are permitted to retain your information within the scope permitted by law; We must retain your information to provide legitimate services;

If meeting your request exceeds the reasonable range of resource usage and technical support. For example, your request can only be completed by developing or constructing a brand new system or changing the current service provision model;

There is a risk of endangering the privacy of others.

Based on your request, we shall inform you in writing about what kind of information ADATA retains, the reason for the retention, and the estimated retention time.

9.5 Right to Receive Information

You are entitled to receive identifiable personal data about you and have the right to request the Company to transmit this information to a third party if permitted by the Company's technical parameters.

9.6 Right to Issue a Complaint

If you believe that ADATA (or a third party that receives transmissions from ADATA) has failed to process your personal data in accordance with the related laws and regulations and failed to resolve your problem after receiving a notification from you, you are entitled to lodge a complaint with the relevant supervisory authority of the country where you live, work, or claim the infringement occurred. You are also entitled to initiate legal proceedings. Such legal proceedings shall be conducted in a court of the country where you live or where ADATA (or the third party that receives the transmissions from ADATA) is located.

10. Privacy Right for Minors

We will not collect personal data from minors under the age of eighteen (18) or otherwise specified in accordance with local laws or regulations without the knowledge of, or obtaining consent from, the minors’ legal representatives. We suggest that the legal representatives should accompany the minors throughout the process of using ADATA products or services. If you are a minor, please obtain consent from your legal representative. You may only provide personal data to Us after you have obtained consent from your legal representative.

Your legal representative may withdraw any consent at any time and contact us by e-mail at pdata@adata.com to update, access, delete, view, download, or reject our use of part or all of your personal data you provided or restrict the purposes for which we use your personal data.

11. Special or Sensitive Personal Data

We will not ask you to, and please do not, provide special or sensitive personal data to ADATA, such as your medical history, medical or health examination records, political orientation, religious and philosophical beliefs, race, union member information, sexual orientation, sexuality Life, criminal record or genetic data.

12. Changes of the Policy

We may revise the Policy from time to time. Therefore, we suggest that you should review the Policy from time to time. If you continue to use ADATA’s products or services after the Policy is revised, you are deemed to have agreed to Our revised policy. We will announce any major changes to the Policy on this service web page, or notify you of the changes via email. You can check the bottom of the Policy page to verify the last update time of the Policy.

13. Contact Us, and Exercise of Right by Concerned Party and Method Thereof

If you have any comments, questions, opinions, or concerns about the Policy or if you think We may have violated the Policy, you are welcome to contact Us at any time.

If you believe that We cannot handle your personal data related dispute properly, you are entitled to lodge a complaint with the competent authority in charge of personal data in your country at any time.

If you wish to inquire about, view, obtain copies of, supplement, or correct your personal data that you have directly or indirectly agreed to our use of, or request that we stop collecting, processing, or utilizing it, or delete it, please contact Us to exercise these rights. The Company reserves the right to collect necessary costs from you as permitted by law, and you shall complete the required application documents and provide documents that afford to verify your identity for our review. If you designate another person to file the application on your behalf, you must provide a power of attorney along with identification documents for both yourself and the agent. The application forms are made available by the Company.

If you do not agree us to share your data with the Company or its partners for continued use, you can also contact Us. Please note that withdrawal of your consent for the Company or its partners to continue using your personal data might result in the inability of the Company and its partners to provide you with full service.

In the event of a personal data security incident that may harm your rights, we will take appropriate measures to address it in accordance with the law and notify the competent authority and affected individuals when legally required.

If you contact ADATA in the manner as described in the Policy, we will respond to your request within one month, at latest.
